This is an adjudication ballot. Not all negative votes cast in the original vote were successfully adjudicated. If you find these negative votes and comments persuasive, this is your opportunity to change your vote in the original ballot.
This adjudication ballot addresses comments submitted regarding proposed modification conflicting with the Food Code. This issue was presented to the Conference for Food Protection (CFP) in April of 2008. The CFP issued a recommendation to the FDA to revise the FOOD CODE to allow a post-sanitizing, potable water rinse for mechanical warewashers.
Other comments included:
• Conflicts with state regulations
• Increased water usage
• Facility space requirements
• Expanded drying time and additional ware storage space for drying
• Introduction of excess water in the kitchen environment that may result in injury
• Boil water advisories and the introduction of an after rinse
• Likelihood that an operator will resort to drying practices that do not comply with Section 4-901.11 of the FDA Food Code
• Increased chances for contamination of clean utensils and equipment prior to use
• Validity of the sanitization efficacy performance criteria & test methods in 6.2 for machines that apply a post-sanitizing rinse.
• Effective delivery of sanitizer to all parts of cleaned equipment and utensils, which may take place, via draining, after application of the sanitizing rinse has stopped;
• Informed selection of available commercial chemical sanitizers, which are typically registered by EPA for use without a rinse after application
• Ability of operators and regulatory officials to verify that all parts of cleaned equipment and utensils have been subject to a process that delivers sanitization.

NOTE - Comments received outside of the scope of the adjudication ballot will be considered non-germane and documented and considered in the same manner as a new proposal.
